  Paris DVD Letter to fans from Roger Hodgson , August 27, 2012

Dear friends,

Many of you have asked me about the status of the Paris DVD, so I wanted to write to you directly with the latest news.  Unfortunately many laws, both legal and moral, were broken and the Paris DVD is now about to be put out using illegal and unethical methods. It is now in the hands of attorneys to resolve the legal dispute between the publishing company and the labels.  I don’t know which side will win, yet what I’ve learned in the music business, it’s usually whichever attorneys have the most funding, not necessarily the ones who are in the right. 

What Eagle Rock and John, Bob and Dougie (who are calling themselves "the Supertramp Partnership") are trying to do is to take away our songwriters rights. Legally, a label needs songwriters’ and publisher’s approval to put this type of product out and instead they are twisting some kind of legal loophole trying to say they don’t need the required licenses. Songwriters are given legal rights and yet in the industry, they are getting ripped off in all kinds of ways and if this goes through, it is going to make things even more difficult for songwriters. What they are trying to do in claiming they can take away the songwriters and publishing rights could make it possible for other labels to do this to other songwriters in the future.  

An attorney friend of mine who has been in the music industry 40 years who is also a publisher and has worked a lot with the Beatles catalog said he has never heard of anyone doing this in the music business - for a label to try to put out a DVD without the publishing company and songwriter’s approval. This whole issue is much bigger than this one DVD.  They are not only trying to take away rights from Rick and myself as songwriters, they are affecting the rights of songwriters all over the world with what they are trying to do.  

Back in the Spring and Summer of 2011 I was working with the band and Eagle in a spirit of cooperation to release the Paris DVD. I spent many many hours reviewing and giving artistic feedback and edits – and this was only at the very beginning of putting together the DVD. There were many things I compromised on, yet we told them I would give my songwriters approval and other rights that I have as a founding member of Supertramp as long as they incorporated the minimal things I asked for – and that they agreed to in writing and then I heard nothing else about it.

Last summer we were told that the DVD was shelved because of whatever quality issues Rick had with it, he did not approve of the release. And we were told Eagle would not release the DVD until they got approval from the publishing company, who represent the songwriters - so I thought the project was dead. Then a few weeks ago I found out the band guys had been working on the DVD all this time secretly behind my back, completely violating the spirit of cooperation I had been in with them up until then.

The only reason I even received a copy was because a fan let me know it was coming out and I asked Eagle to send me one, which I received just a few days ago - after it has already been shipped to distributors. I was shocked receiving the DVD completely manufactured and shrink wrapped before I’d even seen it! There is a whole montage of pictures, bonus materials and liner notes which I have never seen and have never been given the opportunity to comment on. They are putting out a product that is supposed to be representing all five of us, and it’s not. It is only representing the three of them.

Bob, John and Dougie are representing themselves to Eagle as the ‘Supertramp partnership’ and the contract is just between the three of them and Eagle. Whether you are a Rick fan or a Roger fan or both, I feel all fans would agree that it’s not right for the three non-songwriters to control the Supertramp catalog, claiming I have no artistic voice, no input, no say at all in the creation of any Supertramp products, and yet they want to use my performances, my image and likeness and my songs.

To have received this DVD all packaged at the very last minute feels very out of integrity. They have not kept their agreements and have not honored my artistic, creative, technical or editorial inputs at all. For example, I wanted the songs to have correct writer’s credit and for it to be delineated who wrote which songs. And instead they have gone so far as to completely bury who the songwriters are from the public. There is no credit being given to the songwriters or the publishers on the packaging or the film yet credit is being given to the merchandisers, the trucking company and who dressed up in a monkey suit. They don’t list the songwriters at all, giving the illusion to the public that Supertramp wrote the songs, which is not true at all. And they know how important it has been to me as a songwriter to have my songs delineated. That is the only thing that I had to help me continue on with my career beyond Supertramp.

I know the three of them are going to say they are doing it for the fans, but that is not what is really going on. If they were really thinking about the fans, they would know that fans would want me to have input on the DVD. This isn’t about the fans or about the music. This DVD is about a power play, it’s about money, control, envy and underhanded music business tactics and I want nothing to do with it.

For me I truly was getting involved because so many of you have said you wanted a DVD from one of the concerts when I was with the band. And I hope you can understand that while I always wanted something like this out there, I cannot approve of a product that is created with this kind of manipulation and deceit because I believe that the energy and where you come from when you create something is very important.

The other reason I wanted to work on the DVD was to ensure that all five members could share their experiences from that tour, and I wanted to make sure it would be the best quality product possible. Unfortunately, I also cannot endorse the DVD because of its technical shortcomings, editorial inaccuracies and poor quality.

So I don’t want any fans out there to be fooled, and for anyone who decides to buy the DVD, I wanted you to know this DVD was created out of very questionable legal maneuvering. The band that you see playing on the DVD has not existed for 30 years. Now it’s all about business and the business part of music can be ruthless and backstabbing, just as any other business can be.  That is one of the reasons I left LA and wanted to get out of the music business all those years ago.  It’s not how I want to live my life and it’s not why I do music.  

This is one of the reasons that I’m happier now than I ever have been touring the way I’m touring – not caught up in the music industry and all the ugly parts of the business.  No record label owns me, no publisher owns me, no managers own me, no agents own me.  I can stay true to myself and tour when I want, how I want. I can play to 3000 or 85,000 or anywhere in between – I’m ok not playing huge arenas anymore, it’s about playing music to help make people happy, it doesn’t matter what size the audience is.

I became a musician when I was 12. It’s what I love to do and it’s what I’m good at. And I will continue for as long as I can travelling around the world doing concerts. For me, one of the most important things as an artist is to play music for the art, for the magic that’s possible with music to help lift people’s spirits, help open their hearts to receive some healing and relief from all the troubles in this world.

I want to keep this Paris DVD issue separate from what I’ve been striving for all these years as an artist, my reasons for touring and playing music. I know many of you wanted to know my thoughts about the Paris DVD, so that is why I’m just sending this to the fan sites and you’re welcome to leave any comments there on the sites.

Muchos de vosotros me habéis preguntado sobre el  DVD París, así que he querido escribiros directamente con las últimas noticias. Por desgracia, se han roto muchas de las leyes, tanto legales como morales, y el DVD de París que está a punto de editarse se ha hecho con métodos ilegales y poco éticos. Ahora está en manos de los abogados  resolver la disputa legal entre la compañía propietaria de los derechos y la discográfica. No sé que parte va a ganar, sin embargo, lo que he aprendido en el negocio de la música, es que por lo general ganan los  abogados que tienen más recursos, no necesariamente los que tienen  razón.

Lo que Eagle Rock y John, Bob y Dougie (que se llaman a sí mismos "la Asociación Supertramp") están tratando de hacer es quitarnos nuestros derechos como compositores. Legalmente, una discográfica necesita la aprobación de los compositores y de la editorial para poner este tipo de producto a la venta y en su lugar están usando una especie de vacío legal tratando de decir que no necesitan las licencias requeridas. A los compositores se les dan los derechos legales y sin embargo,  la industria, trata de timarlos de todas las maneras posibles, y si ésto sigue adelante, va a hacer las cosas aún más difíciles para los compositores. Lo que están tratando de hacer al afirmar que pueden quitar a los compositores los derechos de autor y  de publicación, es que podría hacerse posible que otras discográficas hagan lo mismo a otros compositores en el futuro.

Un abogado amigo mío que lleva en la industria de la música  40 años, que también es  editor y ha trabajado mucho con el catálogo de los Beatles me dijo que nunca había oído  de nadie que haya hecho ésto en el negocio de la música - una discográfica que trata de publicar un DVD sin la aprobación de la compañía propietaria de los derechos  y los compositores. Todo este asunto es mucho más grande que la publicación de este DVD. Con lo que están intentando hacer, no sólo están tratando de quitarnos los derechos de autor a Rick y a mi como compositores, sino que ésto afecta a  los derechos de autor de los compositores de todo el mundo.

En la primavera y el verano de 2011  estuve trabajando con el grupo y con Eagle, en un espíritu de cooperación para lanzar el DVD de París. Pasé muchas horas revisando los contenidos y dando opinión artística y de edición - y estos fueron los comienzos para montar el DVD. Hubo muchas cosas con las que me comprometí, además, les dije que daría mi aprobación como compositor y otros derechos que tengo como miembro fundador de Supertramp, siempre y cuando se incorporaran las cosas mínimas que pedí - y que se acordó por escrito y después no supe nada más al respecto.

El verano pasado nos dijeron que el DVD fue dejado de lado a causa de algunos problemas de calidad objetados por Rick, y él  no aprobó el lanzamiento. Y nos dijeron que Eagle no lanzaría el DVD hasta que se tuviera la aprobación de la compañía propietaria de los derechos de autor, que representa a los compositores - por lo que pensé que el proyecto estaba muerto. Entonces, hace unas semanas me enteré de que los chicos de la banda habían estado trabajando en el DVD  todo este tiempo en secreto a mis espaldas, violando completamente  el espíritu de cooperación que yo había tenido con ellos hasta entonces.

La única razón para que yo haya recibido una copia fue porque  un fan me hizo saber que iba a salir publicado y le pedí a Eagle que me enviara una, que he recibido  hace tan sólo unos días - después de que ya ha sido enviado a los distribuidores. Me quedé muy impresionado al recibir el DVD totalmente fabricado y  empaquetado sin que yo ni siquiera lo hubiera visto antes! Hay todo una montaje de imágenes, material extra y notas que nunca he visto y que nunca me han dado la oportunidad de comentar. Están publicando un producto que se supone que representa a nosotros cinco , y no lo es. Sólo  representa a  tres de ellos.

Bob, John y Dougie se están representando a si mismos ante  Eagle como la "asociación Supertramp” y el contrato es entre ellos tres e Eagle. Tanto si eres  fan de Rick o fan de Roger o de ambos, creo que todos los fans estarán de acuerdo en que no es correcto que los tres no-compositores controlen el catálogo de Supertramp, alegando que yo no tengo voz artística, ni opinión, ni pueda decir nada en la creación de cualquier producto de Supertramp, y sin embargo quieren usar mis actuaciones, mi imagen, mis fotos y mis canciones.

Haber recibido este DVD  empaquetado en el último momento está muy lejos de la ética. Ellos no han cumplido los acuerdos y no han respetado mis aportes artísticos, creativos, técnicos o editoriales en absoluto. Por ejemplo, yo quería que las canciones tuvieran los créditos correctos para cada escritor para que quedara delimitado quién escribió las canciones. Y en cambio, han ido tan lejos como para ocultar al público completamente quienes son los compositores. No hay créditos para los compositores o la compañía que los representa  en el libreto, o en  la película incluso se están dando créditos a los comerciantes, la empresa de transporte por carretera y a uno vestido con un traje de mono. Ellos no mencionan para nada el listado de los compositores, dando la impresión al público de que Supertramp escribió las canciones, lo cual no es cierto en absoluto. Y ellos saben lo importante que ha sido para mí como  compositor tener  mis canciones claramente delimitadas. Eso es lo único que tenía para ayudarme a seguir adelante con mi carrera más allá de Supertramp.

Sé que los tres  van a decir que lo están haciendo por los fans, pero eso no es lo que realmente está pasando. Si estuvieran realmente pensando en los fans,  sabrían que los fans querrían que yo hubiera participado en el DVD. No se trata ni de los fans ni de  la música. Este DVD trata de un juego de poder, se trata de dinero, de control, de envidia y de turbias tácticas de negocios de la música y yo no quiero tener nada que ver con eso.

Yo realmente quería involucrarme debido a que muchos de vosotros habéis dicho que queríais un DVD de uno de los conciertos de cuando yo estaba en el grupo. Y espero que podáis entender que, si bien siempre he querido que se publicara algo como ésto, no puedo aprobar  un producto que se crea con este tipo de manipulación y engaño, porque creo que la energía y de dónde proviene cuando creas  algo es muy importante.

La otra razón por la que quería trabajar en el DVD era para que los cinco miembros pudiéramos compartir las experiencias de esa gira, y yo quería estar seguro de que sería un producto con la mejor calidad posible. Desafortunadamente, tampoco puedo aprobar el DVD a causa de sus deficiencias técnicas, inexactitudes  editoriales y su baja calidad.

Así que no quiero que ningún fan  sea engañado, y a cualquier persona que decida comprar el DVD, yo querría hacerle saber que este DVD fue creado a partir de maniobras legales muy cuestionables. El grupo que  veréis tocando en el DVD no  existe desde hace 30 años. Ahora todo es un negocio y la parte de  la música como negocio, puede ser despiadado y con puñaladas por la espalda, al igual que ocurre en cualquier otro negocio. Esa es una de las razones por las que dejé Los Ángeles y quise salir del negocio de la música  hace tantos años atrás. No es cómo quiero vivir mi vida y no es por eso por lo que hago música.

Esta es una de las razones por las que estoy más feliz ahora de gira de lo que nunca he estado por la forma en que hago las  giras - no estoy atrapado en la industria de la música ni en toda la parte fea del negocio. Ningún sello discográfico, ningún editor, ningún representante, ni ningún agente es mi dueño. Puedo permanecer fiel a mí mismo y salir de gira cuando quiero, como quiero. Puedo tocar para 3.000 u 85.000 o cualquier cifra en medio -  estoy a gusto sin tocar en grandes estadios nunca más, se trata de interpretar música para ayudar a hacer feliz a la gente, no importa cuánto público haya …

Me convertí en músico cuando tenía 12 años. Es lo que me gusta hacer y es lo que se  me da bien. Y voy a seguir durante tanto tiempo como pueda viajar por el mundo haciendo conciertos. Para mí, una de las cosas más importantes como artista es tocar música por el arte, por la magia que se puede hacer con la música para ayudar a elevar el espíritu de la gente, ayudar a abrir sus corazones para recibir algo de curación y alivio de todos los problemas en este mundo .

Quiero mantener este asunto del DVD de  París al margen de lo que he estado luchando durante todos estos años como artista, mis razones para salir de gira y tocar música. Sé que muchos de vosotros queríais saber mis pensamientos sobre el DVD de París, así que es por eso por lo que estoy enviando ésto a las páginas de fans y os invito a dejar vuestros comentarios en esas páginas.
